Professional Scope and Engagement Framework

The following Terms and Conditions constitute a legally binding professional agreement between Emails by Andreea Team and the Client, governing the strategic development, technical implementation, and management of Email and SMS marketing infrastructures. Engagement with any provided service, including the initial technical audit, signifies an unequivocal acceptance of these operational standards which prioritize data-driven execution and systemic scalability over subjective guesswork. Every new professional partnership is required to commence with a mandatory, comprehensive technical audit of the Client’s existing retention ecosystem conducted by Emails by Andreea Team to identify specific growth levers and behavioral patterns.

Mandatory Audit Fee and Contractual Onboarding

A non-refundable audit fee of one hundred euros (€100) is due prior to this analysis, serving as a prerequisite for the delivery of the initial strategic roadmap. No further implementation or strategic work will be executed by Emails by Andreea Team until a formal Collaboration Contract has been signed by both parties, ensuring a clear legal framework for the partnership. This initial phase is designed to ensure that all subsequent actions are rooted in technical precision rather than general assumptions.

Minimum Commitment Period and Performance Rationale

To ensure the successful engineering of a self-sustaining revenue engine and to allow for the observation of compounding performance results, a mandatory minimum collaboration period of three (3) months is required for all new clients. This timeframe is essential for the stabilization of owned channels, the deployment of advanced lifecycle flows, and the execution of rigorous A/B testing cycles by Emails by Andreea Team necessary to optimize conversion rates and secure long-term account health. Short-term engagements are insufficient for the structural depth required to significantly reduce reliance on volatile paid media performance.

Intellectual Property and Asset Ownership

Throughout the duration of the partnership, Emails by Andreea Team maintains full intellectual property rights over all custom-engineered strategic roadmaps, technical workflows, copywriting, and design assets until the Client has fulfilled all financial obligations for the respective billing period. Upon receipt of full payment, the Client is granted a non-exclusive, non-transferable license to utilize these systems strictly for their internal business operations. Any reproduction or redistribution of these frameworks developed by Emails by Andreea Team to third parties without prior written consent is strictly prohibited.

Client Responsibilities and Infrastructure Access

The Client is solely responsible for providing administrative access to the necessary technical stack to Emails by Andreea Team, including e-commerce platforms like Shopify and marketing ecosystems and email service provider to facilitate seamless integration and data synchronization. Furthermore, the Client guarantees that all provided subscriber data is compliant with global regulations, including GDPR and TCPA, and holds Emails by Andreea Team harmless regarding the legality of the database acquisition. The efficacy of the retention system relies heavily on the quality of the data provided and the timeliness of client-side approvals.

Performance Disclaimer and Limitation of Liability

While all infrastructures are designed to maximize performance and convert the database into a predictable revenue stream, final financial outcomes are subject to external market variables and paid media volatility. Emails by Andreea Team provides decision-grade reporting and high-performance systems but does not offer absolute guarantees on specific revenue figures due to these external dependencies. Emails by Andreea Team shall not be held liable for any indirect or consequential loss resulting from third-party platform downtimes, API failures, or sudden policy changes within the digital ecosystem.

Confidentiality and Termination Protocols

Both parties agree to maintain strict confidentiality regarding proprietary business data, including revenue metrics, list sizes, and unique strategic frameworks developed by Emails by Andreea Team during the collaboration. After the initial three-month commitment is met, either party may terminate the agreement by providing a written notice of thirty (30) days, provided that all outstanding fees for work performed by Emails by Andreea Team up to the termination date are settled in full.

Promotional Usage and Portfolio Rights

Emails by Andreea Team reserves the right to showcase creative assets, including newsletter designs and generalized strategic frameworks, within its professional portfolio, case studies, or public marketing materials, provided that prior verbal or written consent is obtained from the Client. In all such instances, Emails by Andreea Team commits to protecting the Client’s sensitive business information by anonymizing or altering specific financial metrics, revenue figures, and key performance indicators to prevent the disclosure of actual business results. No personal data of the Client’s subscribers will ever be included in these public showcases, ensuring that only the structural and creative excellence of the work is highlighted.
