All services provided by Emails by Andreea Team, including technical audits, strategic roadmaps, and infrastructure implementations, are offered on an “as-is” and “as-available” basis. While Emails by Andreea Team engineers every system to maximize performance and stabilize retention, these services are strategic and technical in nature and do not constitute legal, financial, or tax advice. The Client acknowledges that the success of any retention architecture is dependent on a multitude of external factors, including but not limited to, product-market fit, brand reputation, global economic shifts, and the quality of the Client’s primary acquisition channels.

Limitation of Revenue and Performance Guarantees

Emails by Andreea Team specializes in building high-yield revenue engines; however, the Team does not provide absolute guarantees regarding specific financial outcomes, conversion rates, or precise revenue growth figures. Any past performance metrics or case studies showcased by Emails by Andreea Team serve as evidence of architectural quality and historical success but should not be interpreted as a promise of future results for any specific brand. The Client understands that email and SMS marketing are components of a larger business ecosystem, and the final ROI is subject to variables that Emails by Andreea Team does not control, such as the Client’s pricing strategy and paid media volatility.

Third-Party Platform Dependencies and Technical Failures

The retention infrastructures developed by Emails by Andreea Team rely on integration with third-party enterprise platforms, including Shopify, Klaviyo, and various SMS gateways. Consequently, Emails by Andreea Team shall not be held liable for any damages, loss of data, or loss of revenue resulting from technical malfunctions, server downtimes, API failures, or sudden policy changes initiated by these third-party providers. While Emails by Andreea Team bridges the gap between creative and technical execution, the Team is not responsible for the underlying stability or pricing structures of the software ecosystems selected for the Client’s infrastructure.

Boundary of Liability and Indemnification

To the maximum extent permitted by law, Emails by Andreea Team shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the implemented marketing systems. The Client agrees to indemnify and hold harmless Emails by Andreea Team from any claims, losses, or legal fees resulting from the Client’s use of the database, including any violations of privacy regulations or anti-spam laws (such as GDPR or TCPA) linked to the data provided by the Client. The total liability of Emails by Andreea Team for any claim arising out of the professional relationship shall not exceed the total amount paid by the Client to Emails by Andreea Team during the preceding three-month period.
